Terms of service

These terms are the agreement between you and THE BOILING ROOM SRL ("we", "us") for using SwingersPlayLive. Please read them together with our content policy and privacy policy.

1. Who can use SwingersPlayLive

  • You must be at least 18 years old and an adult under the law where you live. We may ask you to verify your age or identity.
  • You must be legally allowed to view adult-oriented content where you are. Do not use SwingersPlayLive where it is illegal.
  • One account per person or per couple. A couple shares one profile and one membership; both partners must be adults, agree to the profile and follow these terms.
  • You may not use SwingersPlayLive if we have previously suspended your account, or if you are a registered sex offender.

2. Your account

Keep your login details secure and your profile truthful (ages, member type, location at city level). You are responsible for activity on your account. Tell us at contact@swingersplaylive.com if you think your account has been misused.

3. What is free and what is paid

  • Free: searching members, clubs and places; viewing full profiles after you create a free account; replying to messages other members send you.
  • Paid (Premium and other plans): for example starting new conversations, travel mode and other features described on the membership page.

Prices, billing period, whether a plan renews automatically and the renewal price are shown before you pay. Payments are processed by our payment provider (CCBill), whose terms also apply to the payment. You can cancel a renewing plan bought on our website at any time in your account; cancellation stops future renewals and you keep access until the end of the period you paid for.

Right of withdrawal. If you change your mind, you can withdraw from a new purchase within 14 days of buying, from Account → Membership, and we refund you within 14 days. This right comes from EU and UK consumer law; we offer it for every purchase made on our website. It covers subscriptions and one-time payments alike. We stop any renewal of that purchase and confirm your request by e-mail; we refund the payment in full to the card you paid with, and the access paid by that purchase ends when the refund is made. Other consumer rights that apply where you live are not affected by these terms.

Plans paid through Google Play. If you pay for a plan in our Android app, Google Play takes the payment and Google Play’s terms also apply to it. A plan that renews automatically renews through Google Play until you cancel it in the Play Store (profile picture → Payments & subscriptions → Subscriptions); cancelling stops future renewals and you keep access until the end of the period you paid for. Refunds for these payments, including a withdrawal, are handled by Google Play under its own refund policies: ask for one in your Google Play order history. The cancellation and the withdrawal from your account described above do not apply to them; your statutory rights are not affected. If you delete your account, we ask Google Play to stop the automatic renewal.

Plans paid through the App Store. If you pay for a plan in our iPhone app, Apple takes the payment and Apple’s terms also apply to it. A plan that renews automatically renews through the App Store until you turn off its automatic renewal on your iPhone (Settings → your name → Subscriptions); turning it off stops future renewals and you keep access until the end of the period you paid for. Refunds for these payments, including a withdrawal, are handled by Apple under its own refund policies: ask for one at reportaproblem.apple.com. The cancellation and the withdrawal from your account described above do not apply to them; your statutory rights are not affected. Only you can stop the automatic renewal: deleting your account does not stop it.

The iPhone app. If you use our iPhone app, Apple’s standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) also applies to your use of the app. Apple is not a party to these terms and is not responsible for SwingersPlayLive or its support: contact us instead.

4. Your content

You keep ownership of what you post. You give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize and display your content only to operate and improve SwingersPlayLive, for as long as it is on the service (and for backups and legal obligations for a limited time afterwards). You confirm that you have the rights to what you post and that every person shown in your photos is an adult who agreed to it being posted on SwingersPlayLive.

Consent to publication. By uploading a photo or video to SwingersPlayLive, you agree to its download, streaming, publication and distribution on SwingersPlayLive, to the members who can see it under your settings and our rules. You confirm that every person shown in it has given the same consent.

5. Rules and moderation

You must follow our content & community policy. We review content with automated tools and people, may refuse, hide or remove content, limit features or suspend accounts that break the rules or the law, and we explain our decisions and how to appeal them. New photos are approved or rejected by automated checks. Decisions about photos, whether automated or taken by our team after a report, cannot be appealed with us; you can go to court. We may report illegal activity to the authorities.

6. Meeting people safely

We verify some information (for example e-mail addresses, and age or identity when you choose to verify), but we cannot verify everything members say. Use good judgement, meet in public first, respect boundaries and consent, and read our safety guide. Members are responsible for their own conduct online and offline.

7. Profiles from our network

We also operate the SwingersPlay network of lifestyle websites. Some SwingersPlayLive listings belong to members of that network; they are shown with limited information and can be claimed or removed by their owner at any time. Messages sent to these members are delivered to them by e-mail.

8. Ending the agreement

You can stop using SwingersPlayLive and delete your account at any time. We may suspend or close accounts that break these terms or the law, with a statement of reasons and a way to appeal, except where the law or safety prevents us from telling you.

9. Liability

We provide SwingersPlayLive with reasonable care and skill, but we cannot guarantee that it will always be available or error-free, or that you will meet anyone. To the extent the law allows, we are not liable for indirect losses or for the conduct of members. Nothing in these terms limits liability that cannot be limited by law, including your statutory rights as a consumer.

10. Changes

We may update these terms. For significant changes we will tell you in advance by e-mail or on the site; if you do not agree, you can close your account before the change takes effect.

11. Law and disputes

These terms are governed by the law of Romania, where THE BOILING ROOM SRL is established, without depriving you of the protection of the mandatory consumer laws of the country where you live, and you may bring claims in the courts where you live. EU consumers can also use a certified out-of-court dispute settlement body.
